Terms of Service

1. Acceptance of Terms
By accessing or using Locci Realtors ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users including landlords, property managers, and tenants browsing available listings.
2. Use of the Platform
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others. You must not misuse the Platform by introducing malicious code, attempting unauthorized access, or using the service to transmit unsolicited communications.
3. User Accounts
To access landlord features, you must create an account and authenticate via our OAuth provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@loccirealtors.co.ke if you suspect unauthorized use of your account.
4. Property Listings
Landlords are responsible for ensuring that property listings are accurate, complete, and comply with applicable Kenyan housing laws. Locci Realtors does not verify the accuracy of listings and is not responsible for any transactions entered into based on listing information. Fraudulent listings will result in immediate account termination.
5. Payment Terms
Subscription fees (for Pro and Enterprise plans) are billed monthly in Kenyan Shillings (KES). All fees are non-refundable unless otherwise required by law. We reserve the right to modify pricing with 30 days' notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
6. M-Pesa and Payment Processing
M-Pesa payments are processed through IntaSend, a licensed payment service provider in Kenya. By initiating M-Pesa transactions through the Platform, you agree to IntaSend's terms of service and Safaricom's M-Pesa terms. Locci Realtors is not responsible for failed transactions due to network issues, insufficient M-Pesa balance, or actions by payment processors.
7. SMS Notifications
By providing a phone number on the Platform, you consent to receiving SMS notifications related to your account, leases, payments, and maintenance updates via Africa's Talking. Standard mobile carrier rates may apply. You may opt out of non-essential notifications in your account settings.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.
9. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may terminate your account at any time by contacting us. Upon termination, your data will be retained for 90 days before deletion, during which time you may request an export.
10. Limitation of Liability
To the maximum extent permitted by Kenyan law, Locci Realtors shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you have paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
